Fundamental Estate Planning
Serving Clients in Lexington and the Surrounding Area
It is a common misconception that estate planning is simply about wills and trusts. Although trust and wills are some of the tools we utilize, we believe that they are the by-products or end result of estate planning. When clients engage us for estate planning we help them maintain control of their property while they are alive and well, take care of themselves and their loved ones if they become disabled, and give what they have to whom they want, in the way that they want, while allowing them to save all the tax dollars, administration fees, and court costs legally possible.
We believe that effective estate planning should address following areas:
Incapacity/Disability Planning
- Financial Control
- Medical Decision Control
- Access to Information
- Family Maintenance
- Dependent Protection
- Long-term Care
- Maintain Privacy
- Eliminate Court Intervention
Wealth Transfer Planning
- Streamlined Transfers
- Reduce Administrative Delays
- Reduce Cost of Transfers
- Reduce or Eliminate Taxes
- Avoid Family Conflict
- Preserve Asset Values
- Maintain Privacy
- Eliminate Court Intervention
- Leave a Legacy
Beneficiary Protection
- Minor Guardianships
- Young Adult Protection
- Spendthrift Protection
- Special Needs Planning
- Creditor & Predator Protection
- Beneficiary Divorce Protection
- Promote Family Harmony
Estate Planning for Singles
Serving Individuals throughout Lexington, Massachusetts and the Surrounding Areas
It is important for singles to have an estate plan in place that lays the groundwork for allowing someone else to make financial and medical decisions on your behalf, if you are not able to do so. Further, singles need to think and plan where their assets would pass at death, because there may not be a clear set of beneficiaries (like a spouse or children). Without a Will, the probate court will rely on state law to determine the order of inheritance.
A Power of Attorney for financial affairs appoint someone to act on your behalf if you become incapacitated. Without this document, a court would need to appoint someone to handle important financial decisions for you. That process can delay access to bank accounts and make it difficult to access money needed to pay bills.
A Health Care Proxy appoints someone to act on your behalf to make medical decisions. It also spells out precisely what types of interventions you agree to if you are unable to communicate your wishes. This document must be in place to allow someone of your choosing to carry out your wishes.

Estate Planning for Minor Children
Serving Families and Individuals throughout Lexington, Massachusetts and the Surrounding Areas
Minor Children
Our children are our most precious asset. Putting in place the necessary documents and plan in case of your incapacitation or death ensures that you select your children’s guardians, directions in how their inheritance should be managed, and who their financial fiduciary will be, instead of having a judge make those decisions for you.
Constant Law Group, P.C. will walk you through these critical decisions and ensure that you have the correctly executed documents and put a plan in place to take care of your minor children.
Young Adult Program
We can also consult on documents and plans for when your child is ready to leave the nest and head to college. Once a child turns eighteen (18) having a Health Care Proxy and updated HIPAA forms is important to ensure your eligibility in acting on their behalf to make medical decisions when they can’t, allowing you to keep taking care of them when they need you most.
Our Young Adult Program is a program we offer to our Estate Planning Clients for their young adult children. Our mission is to help our clients plan for everything they own and everyone they love. Estate Planning for Blended Families
Serving Families throughout Lexington, Massachusetts and the Surrounding Areas
At Constant Law Group we take a different approach to planning for our clients. Blended families may include second marriages or non-traditional configurations and all benefit by an estate plan that specifies a list of individuals you want to name in your documents to serve as agents during incapacity or upon your death, as well as individuals whom you wish to receive your assets and possessions. This can be especially important to help support a surviving spouse post-death to carry out your wishes regarding your children and each other.
We can help you work through those issues while facilitating communication and providing you with legal advice to create a plan that will fulfill your wishes.
